Islamabad: Nine Pakistan Justice Movement (BTI) The affiliated candidates who contested the elections on February 8 in different constituencies in the national and regional councils demanded The Chief Justice resigned to Pakistan (CJP) Justice Faiz Isa of the court hearing the issue of election tribunals appointed in Punjab to handle matters related to election disputes, News International reported.
A larger five-member panel of the Supreme Court, headed by the Chief Justice, will hear the appeal. Election Commission of Pakistan (ECP) against the Lahore High Court’s order on setting up of Election Tribunals in Punjab to handle electoral disputes arising out of the February 8 general elections.
In addition to Judge Qazi Faiz Isa, the bench includes Judge Aminuddin Khan, Judge Jamal Khan Mandokhayil, Judge Naeem Akhtar Afghan, and Judge Aqeel Ahmed Abbasi.
On July 4, the Supreme Court suspended the Lahore High Court’s judgment and its notification appointing eight election tribunals in Punjab. This suspension remained in effect until consultations between the Chief Justice of the Lahore High Court and the Election Commission were completed.
In their petition to the Supreme Court, the PTI lawmakers sought permission to file their applications for Justice Isa's recusal from the bench hearing the election tribunal case.
The nine candidates of the Pakistan Tehreek-e-Insaf (PTI) party are Shaukat Iqbal Mirza, Raja Rashid Hafeez, Saad Ali Khan, Chaudhry Muhammad Nazir, Hassan Adil, Nasir Khan, Seemabia Tahir and Shehryar Riaz. These lawmakers have been named as respondents in the election tribunals case.
They informed the Registrar of the Supreme Court that they had attempted to file a separate civil suit in this case, requesting that the Chief Justice recuse himself from hearing the case for certain legal reasons.
However, they said that the Advocate of Record (AOR) did not submit their applications for reasons known to the said AOR and no written communication was made, The News International reported.
They then stated that they had tried to file this application in person, but the institution's branch at the Supreme Court Office had not received the application, indicating that it could not be filed in person. The lawmakers stated that they should not be prevented from filing a request for a fair ruling on this matter.
They urged the registrar to allow them to file an appeal in person, as a hearing is already scheduled for August 19. Meanwhile, the lawyer for the defendant Salman Akram Raja Hamid Khan has requested an adjournment of the case, The News International reported.
Khan has filed an application through Advocate on Record (AOR) Syed Rafiq Hussain in the High Court seeking an adjournment of the case. He stated in the application that Hamid Khan is out of the country from August 16 to September 6 and will not be able to appear before the court on August 19. He has requested an adjournment of the case.
